By accessing or using the GoCrewIT platform and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

GoCrewIT provides a cloud-based field service management platform that enables contractors and service businesses to:

• Manage work orders and job scheduling
• Collect digital signatures and documentation
• Track crew locations and job progress
• Generate invoices and manage billing
• Store and organize project photos and documents
• Communicate with team members and customers

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to create an account
• One person or entity may maintain only one free account

3.2 Account Responsibility

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage from your failure to protect your account information
• You may not share your account credentials with others

3.3 Account Termination

• You may terminate your account at any time through your account settings
• We may suspend or terminate your account for violations of these Terms
• Upon termination, your right to use the Service ceases immediately
• We will provide reasonable notice before termination unless immediate action is required

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the Service only for:

• Legitimate business purposes related to field service management
• Compliance with all applicable laws and regulations
• Authorized business activities within your organization

4.2 Prohibited Uses

You may NOT use the Service to:

• Violate any applicable federal, state, local, or international law
• Transmit malicious code, viruses, or harmful software
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated scripts or bots to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, redistribute, or sublicense the Service without authorization
• Upload or transmit copyrighted material without permission
• Harass, abuse, or harm other users
• Use the Service for illegal activities or to facilitate illegal activities
• Store or transmit content that is defamatory, obscene, or offensive

4.3 Content Standards

All content you upload or transmit must:

• Be accurate and truthful to the best of your knowledge
• Not violate any third-party rights
• Comply with applicable privacy laws
• Be appropriate for a business environment

5. Subscription Plans and Billing

5.1 Subscription Plans

• Service is provided on a subscription basis with various plan options
• Plan details, features, and pricing are available on our website
• We reserve the right to modify plans and pricing with reasonable notice

5.2 Payment Terms

• Subscription fees are charged in advance on a monthly or annual basis
• All fees are non-refundable except as expressly stated in these Terms
• You authorize us to charge your designated payment method
• Prices are exclusive of taxes, which you are responsible for paying

5.3 Auto-Renewal

• Subscriptions automatically renew for the same period unless cancelled
• You may cancel auto-renewal through your account settings
• Cancellation must be made before the next billing cycle
• No refunds will be provided for partial billing periods

5.4 Late Payment and Suspension

• Accounts may be suspended for non-payment after reasonable notice
• Late fees may apply for overdue payments
• Service will be restored upon payment of outstanding amounts
• Data may be deleted after extended non-payment periods

5.5 Free Trial

• Free trials are available for new customers only
• Trial limitations are specified during signup
• Trials automatically convert to paid subscriptions unless cancelled
• We reserve the right to modify or discontinue free trials

6. Intellectual Property Rights

6.1 GoCrewIT's Rights

• The Service, including all software, technology, and content, is owned by GoCrewIT
• We retain all rights, title, and interest in our intellectual property
• You receive only a limited license to use the Service as specified in these Terms
• Our trademarks, logos, and brand elements may not be used without permission

6.2 Third-Party Platform Dependencies

• The GoCrewIT Service is built on Google AppSheet, a product of Google LLC
• Your use of the Service is subject to Google's applicable terms and conditions, including but not limited to Google's Terms of Service and Google AppSheet's terms
• GoCrewIT does not own, control, or license Google AppSheet or any Google services
• Any issues, limitations, or changes to Google AppSheet functionality are beyond GoCrewIT's control
• GoCrewIT is not responsible for any interruptions, modifications, or discontinuation of Google AppSheet services
• You acknowledge that continued availability of the GoCrewIT Service depends on our ongoing access to Google AppSheet
• Google's terms and privacy policies apply to the underlying platform infrastructure

6.3 User Content License

• You retain ownership of all content you upload to the Service
• You grant us a worldwide, non-exclusive license to use, store, and process your content as necessary to provide the Service
• This license terminates when you delete content or close your account
• You represent that you have the right to grant this license

6.4 Feedback and Suggestions

• Any feedback or suggestions you provide may be used by us without obligation
• You waive any rights to compensation for feedback provided
• Feedback becomes our property and may be incorporated into the Service

7. Data and Privacy

7.1 Data Ownership

• You own all data you input into the Service
• We do not claim ownership of your business data
• You are responsible for the accuracy and legality of your data

7.2 Data Processing

• We process your data in accordance with our Privacy Policy
• You consent to data processing as described in our Privacy Policy
• We implement reasonable security measures to protect your data

7.3 Data Backup and Recovery

• We perform regular backups of Service data
• We are not responsible for data loss due to user error
• Data recovery services may be available for an additional fee
• You are responsible for maintaining your own data backups

7.4 Data Export and Portability

• You may export your data through available export features
• Data export may be subject to format limitations
• We will assist with data migration upon reasonable request

8. Service Availability and Support

8.1 Service Level

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions beyond our reasonable control

8.2 Customer Support

• Support is provided during normal business hours
• Response times vary based on subscription plan and issue severity
• Support is provided in English via email and online chat
• Premium support options may be available for higher-tier plans

8.3 Updates and Modifications

• We may update the Service to improve functionality and security
• Updates may change or remove features with reasonable notice
• We are not obligated to maintain compatibility with older versions

9. Limitation of Liability

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Damages

IN NO EVENT SHALL GOCREWIT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.

9.3 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

9.4 Third-Party Platform Limitations

• GoCrewIT is not liable for any issues arising from Google AppSheet or other third-party services
• Service availability and functionality depend on third-party platforms beyond our control
• We disclaim all warranties related to third-party platform performance
• Any claims related to Google AppSheet should be directed to Google LLC

9.5 User Responsibility

You acknowledge that:

• You use the Service at your own risk
• You are responsible for compliance with applicable laws
• You should maintain appropriate insurance coverage
• You should backup your data regularly

10. Indemnification

You agree to indemnify, defend, and hold harmless GoCrewIT, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the Service

11. Termination

11.1 Termination by You

• You may terminate your account at any time through account settings
• Termination does not relieve you of payment obligations for services already provided
• You are responsible for exporting your data before termination

11.2 Termination by Us

We may terminate or suspend your account immediately if you:

• Breach these Terms or our policies
• Fail to pay fees when due
• Engage in fraudulent or illegal activities
• Pose a security risk to the Service or other users

11.3 Effect of Termination

Upon termination:

• Your access to the Service will cease
• We may delete your data after a reasonable period
• Provisions that should survive termination will remain in effect
• You remain liable for any outstanding fees

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Illinois without regard to conflict of law principles.

12.2 Arbitration Agreement

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except for:

• Claims for injunctive relief
• Small claims court matters
• Intellectual property disputes

12.3 Class Action Waiver

You waive any right to participate in class action lawsuits or class-wide arbitration against GoCrewIT.

12.4 Venue

Any legal proceedings not subject to arbitration shall take place in Cook County, Illinois.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and GoCrewIT regarding the Service and supersede all prior agreements.

13.2 Modifications

We may modify these Terms at any time by posting updated terms on our website. Continued use of the Service constitutes acceptance of modified terms.

13.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

13.5 Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

13.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

13.7 Notices

Legal notices will be sent to the email address associated with your account. You are responsible for keeping your contact information current.

13.8 Export Controls

The Service may be subject to export controls. You agree to comply with all applicable export laws and regulations.
